TERMS AND CONDITIONS FOR THE PROVISION OF MEDICAL SERVICES, APPOINTMENT BOOKING, AND ONLINE REGISTRATION

Key booking rules

  • The reservation is provisional until a deposit of 250 PLN per person is successfully paid or the financing entity confirms the financing agreement.
    The deposit must be paid within 20 minutes of making the reservation; if you choose the installment option, you have 60 minutes to obtain financing confirmation.
    Cancellation of an appointment more than 48 hours in advance is possible by phone (+48 22 100 43 08), by email (info@amcprofilaktyka.pl), or—if this feature is available—by replying “NO” to the SMS message confirming the appointment; in this case, the deposit is refundable.
    Rescheduling an appointment is possible no later than 24 hours before the scheduled examination time, subject to availability.
    The Patient should arrive at the Facility at least 15 minutes before the scheduled examination time.
    Due to the nature and duration of medical services, there may be delays in admitting Patients; a delay of up to 1.5 hours does not in itself constitute grounds for a complaint or a claim for compensation, subject to mandatory provisions of law.
    If a Patient is more than 15 minutes late, the appointment may be forfeited without the right to a refund of the deposit, due to the duration of the examination, subsequent appointments, and the well-being of waiting Patients.
  • For appointments financed through installment payments, once the financing agreement has been concluded, cancellations are not permitted; rescheduling is only allowed up to 24 hours before the appointment, subject to mandatory legal provisions and the terms of the financing agreement.
    Failure to attend the examination or failure to reschedule the appointment within the required time frame will result in the cancellation of the reservation.

§ 1. General Provisions

  1. These Terms and Conditions set forth the rules governing the provision of paid medical services by AMC MEDICAL sp. z o.o., with its registered office in Warsaw, including rules regarding appointment scheduling, payments, deposit payments, use of online registration, appointment cancellations and rescheduling, complaints, and the basic rights and obligations of Patients.
  2. These Terms and Conditions apply to the healthcare services offered by the Facility, in particular to preventive full-body ultrasound examinations and other fee-based services listed in the Facility’s current price list.
  3. The facility provides medical services in accordance with generally applicable laws, in particular the Act on Medical Services, the Act on Patient Rights and the Patient Rights Ombudsman, the Act on the Provision of Electronic Services, data protection regulations, and relevant consumer protection laws.
  4. The current version of the Terms and Conditions is available to patients at the facility and on the facility’s website.

§ 2. Definitions

  1. Facility – AMC MEDICAL, LLC, headquartered in Warsaw.
  2. Patient – a natural person who uses or intends to use the healthcare services offered by the Facility, as well as a person making a reservation on behalf of another person.
  3. Service / Online Registration – IT solutions provided by the Facility that allow patients to schedule appointments, submit information, contact the Facility, make payments, or apply for financial assistance.
  4. Appointment – a scheduled time for the provision of a healthcare service or the performance of an examination.
  5. Deposit – a fee of 250 PLN paid per person to secure a reservation, which is applied toward the total cost of the service in accordance with the rules set forth in the Terms and Conditions.
  6. Financing / installment payments – a method of paying for a service through an external financing entity, specifically Comfino or a company that partners with the Facility.
  7. Business day – any day from Monday through Friday, excluding public holidays.

§ 3. Scope of services and nature of service provision

  1. The facility provides health services for a fee, in accordance with the current price list, the scope of the medical staff’s expertise, and applicable organizational and medical standards.
  2. The scope of a specific service, its price, the expected duration, and instructions for the patient’s preparation for the examination are provided to the patient prior to the appointment or made available on the facility’s website.
  3. If, in providing a service, the facility uses IT or analytical tools to assist in describing the examination, such tools are intended to be supplementary and do not replace the assessment of a physician or medical personnel authorized to provide health care services.

§ 4. Scheduling an appointment and signing the contract

  1. You can schedule an appointment by phone, through the website, via email, or in person at the facility.
  2. When making a reservation, the patient is required to provide the information necessary to schedule and provide the service, including, in particular, first name, last name, phone number, email address, and—if required—PESEL number or other information necessary for maintaining medical records and billing.
  3. Once you select a date, only a preliminary reservation is made. The reservation is confirmed after:
    1. upon receipt of a deposit of 500 PLN per person booked, or upon the Facility’s receipt of reliable confirmation of payment, or
    2. upon the Institution’s receipt of information confirming the successful conclusion of a financing agreement with the financing entity.
  4. The preliminary reservation expires automatically without the need for the Institution to submit any additional statements if, within the following time frame:
    1. If a deposit is not successfully paid within 20 minutes of making the reservation—in the case of a standard payment, or
    2. If you choose to pay in installments, the facility will not receive confirmation of the financing agreement within 60 minutes of making the reservation.

§ 5. Prices and payment methods

  1. The prices of healthcare services are gross prices and are listed in the Facility’s current price list, which is available on the Website and at the Facility.
  2. Payments for services can be made:
    1. online, using the available payment methods;
    2. by bank transfer;
    3. on-site at the facility;
    4. in the form of installment financing offered by an external financing entity, specifically Comfino or a partner company.
  3. The deposit is applied toward the cost of the service provided on the reserved date.
  4. For packages covering more than one person, a deposit is charged separately for each person, unless the Facility expressly stipulates otherwise in a given case.

§ 6. Deposit

  1. To secure your reservation, a deposit of 250 PLN per person is required. This deposit serves as a reservation fee and ensures that staff are scheduled, the examination is organized, and the service is ready to be provided at the agreed-upon time.
  2. Payment of the deposit constitutes acceptance of these Terms and Conditions regarding the rules for booking, canceling, and rescheduling appointments.
  3. The deposit will be applied toward the service fee on the date the service is provided.
  4. The deposit is refundable or transferable only in the cases specified in the Terms and Conditions or as required by mandatory provisions of law.

§ 7. Canceling an appointment and rescheduling – general guidelines

  1. A patient may cancel an appointment more than 48 hours before the scheduled appointment time:
    1. by phone at +48 22 100 43 08, or
    2. by email to info@amcprofilaktyka.pl, or—if this option is available—by replying “NO” to the text message confirming your appointment.
  2. If an appointment is successfully canceled in accordance with paragraph 1, the deposit shall be refunded to the Patient, generally using the same method by which it was paid, without delay, and no later than 14 business days from the confirmation of the cancellation.
  3. Patients may reschedule their appointment no later than 24 hours before the scheduled time of the examination. Rescheduling is subject to availability and must be confirmed by the facility.
  4. If a patient contacts the Facility to cancel or reschedule an appointment less than 48 hours, but no less than 24 hours, before the scheduled examination time, the Facility is not obligated to refund the deposit in cash; However, subject to availability, the Patient may transfer the deposit to a new appointment once, provided that the appointment is successfully rescheduled no later than 24 hours before the scheduled examination time.
  5. If the appointment is not successfully rescheduled at least 24 hours in advance, the deposit will be forfeited, and a new deposit must be paid to schedule a new appointment.
  6. A cancellation or rescheduling of an appointment is considered effective at the time the Facility confirms receipt of the request. For requests sent outside the Facility’s business hours, they are deemed to have been received at the time they are actually read by the Facility.

§ 8. Visits paid for in installments

  1. If you choose installment financing, the financing agreement is entered into between you and an external financing entity. The facility is not a party to the financing agreement, unless otherwise expressly stated in the financing documents.
  2. For the purposes of settlements with external funding entities, the Facility stipulates that, once a funding agreement has been effectively concluded, cancellation of an appointment is not permitted, and the Patient may only reschedule the appointment no later than 24 hours before the scheduled examination time, subject to availability.
  3. Changing the date of an appointment financed through installment payments does not automatically result in the termination, cancellation, or modification of the terms of the financing agreement.
  4. The terms and conditions governing the conclusion, withdrawal, termination, early repayment, costs, and settlement of a financing agreement are set forth in separate legal provisions, as well as in the financing entity’s terms and conditions and agreement.
  5. If the appointment for a visit financed in installments is not rescheduled at least 24 hours before the scheduled time of the examination, or if the Patient fails to attend the examination, the appointment is forfeited; this does not affect the provisions of mandatory law or the Patient’s rights under the financing agreement.

§ 9. Attendance, delays, and cancellations by the facility

  1. The patient should arrive at the facility at least 15 minutes before the scheduled appointment time to complete the necessary paperwork and prepare for the examination.
  2. Due to the nature, duration, and medical specifics of the services provided, there may be delays in admitting patients. A delay in admission of up to 1.5 hours does not in itself constitute a breach of contract or grounds for a complaint or claim for damages, subject to mandatory provisions of law.
  3. If a patient fails to show up for an appointment at the scheduled time or is more than 15 minutes late, and as a result it is impossible to provide the service according to the facility’s schedule or without disrupting subsequent appointments and the well-being of waiting patients, the appointment will be forfeited.
  4. For appointments requiring a deposit, if the patient fails to show up or is more than 15 minutes late, resulting in the cancellation of the appointment, the deposit will be forfeited and is non-refundable.
  5. For appointments financed through an installment plan, a patient’s failure to show up or a delay of more than 15 minutes does not automatically result in the termination of the financing agreement, unless otherwise provided by separate regulations or the terms of the financing agreement.
  6. If it proves impossible to provide the service by the agreed date for reasons attributable to the Facility, in particular due to the unavailability of medical staff, a breakdown, force majeure, or another unforeseen organizational event, the Facility shall immediately inform the Patient and propose a new date or—at the Patient’s request—refund the deposit paid or any other payment received in the appropriate amount.

§ 10. Complaints

  1. A patient may file a complaint regarding the booking process, payment, the operation of the online registration system, or the manner in which services are provided, subject to separate rules governing liability for the provision of health care services as set forth by law.
  2. Complaints may be submitted:
    1. by email to info@amcprofilaktyka.pl, or
    2. in writing to the address of the facility’s headquarters.
  3. The complaint should include the patient’s identifying information, a description of the concerns, and the patient’s request, if any.
  4. The facility will review the complaint promptly, no later than 30 days from the date of receipt. If additional information is needed to review the complaint, the facility may ask the patient to provide it.

§ 11. Patient Rights and Medical Records

  1. Patients are entitled to the rights set forth in applicable laws, including, in particular, the right to information, the right to consent to medical treatment, the right to privacy and dignity, the right to confidentiality of their personal information, and the right to access their medical records.
  2. The facility maintains, stores, and provides access to medical records in accordance with the Act on Patient Rights and the Patient Rights Ombudsman, as well as other applicable regulations.
  3. The first disclosure of medical records to the patient or the patient’s legal representative is provided free of charge to the extent required by applicable law. Fees for subsequent disclosures of medical records are determined in accordance with applicable law and communicated to patients in the manner prescribed by law.

§ 12. Services provided electronically

  1. Through the Website, the Facility provides free electronic services, including, in particular, the ability to schedule appointments, provide organizational information, communicate with Patients, and process payments or redirect users to a payment or financing provider.
  2. To use the Website, you need a device with Internet access, a current web browser, an active email address, and a phone number capable of receiving messages or calls.
  3. Patients are prohibited from providing illegal content or engaging in activities that could disrupt the operation of the Website.
  4. The agreement for the provision of electronic services is entered into as soon as the Patient begins using the Website’s features and terminates upon the Patient’s cessation of use of such features, subject to the terms of any reservations made.

§ 13. Personal information

  1. The controller of patients’ personal data is AMC MEDICAL sp. z o.o., with its registered office in Warsaw.
  2. Patients’ personal data is processed, in particular, for the purposes of scheduling appointments, maintaining medical records, providing healthcare services, contacting patients, billing, handling complaints, and fulfilling legal obligations.
  3. Detailed information regarding the processing of personal data, the legal basis for such processing, data retention periods, and the rights of data subjects is provided in the Privacy Policy made available by the Institution.

§ 14. Provisions regarding consumer law

  1. The provisions of these Terms and Conditions do not exclude or limit the rights of Patients who are consumers under mandatory provisions of law.
  2. Contracts for health services concluded at a distance or off-premises are subject to the relevant provisions of consumer law to the extent that such provisions apply to such contracts.
  3. If the Patient has a statutory right to withdraw from the contract or any other statutory right that affects the terms of settlement, the provisions of these Terms and Conditions regarding deposits, cancellations, and refunds shall apply in accordance with such provisions.
  4. The scheduling, completion, or cancellation of an appointment does not automatically alter the Patient’s rights and obligations under a separate financing agreement entered into with the financing entity.

§ 15. Final Provisions

  1. These Rules and Regulations shall take effect on the date of their publication by the Institution.
  2. In matters not covered by these Terms and Conditions, the provisions of generally applicable Polish law shall apply.
  3. The facility may amend these Terms and Conditions for valid reasons, particularly in the event of changes to applicable laws, the scope of services provided, the booking process, or payment methods. Amendments to these Terms and Conditions do not affect the rights of Patients with respect to appointments booked before the amendments take effect.
